Article 01 - Purpose

Purpose The following stipulations provide the terms and conditions for the information supplied and the services performed in relation with :
1/ Personalised private luxury tours and corporate luxury travel arrangements
2/ Hotels, cars, restaurants and holiday villas reservations

Article 02 - Your acceptance

Your acceptance Applying for any one of the services offered on our site, notably but not limited to the services described in Article 4 constitute your full acceptance of:
1/ the terms and conditions set out herein as well as those included in the electronic documents sent to you during the reservation process, in particular our offer, the reservation confirmation form and our invoice.

2/ the utilization by our company of electronic documents including – but not limited to - our offers, our reservation confirmations, invoices and travel documents which will be communicated to you by e-mail, or by means of interactive links on our website and/or on our e-mails.

Article 03 - Informations sur notre site et réserves

Informations sur notre site et réserves We make every effort to ensure that the information contained on our web site is accurate and up to date. We cannot be held responsible for any error or inaccuracy. Our company will not be liable for any actions you may take as a result of using such information. Our Company rejects in advance any action which a visitor or a customer could institute of this fact with regard to us. The Internet user before leaving has to verify that he respects the local authorities for the formalities of police, customs or health.

Article 04 - Our services

Our services Voyage In Provence offers and undertakes the following types of services :
- Creation, organisation and follow-up of independent tailor made luxury tours with programmes fitting your personal requests.
- Organisation, implementation and follow-up of upscale corporate travel arrangements.
- Hotels, lodges, resorts and camps booking services.
- Reservation of private yacht and car rental
- Holiday homes rental
- Organisation, reservation and follow-up of all the services to move in south of France for individuals and professionals.

Article 05 - Responsibility

Responsibility When you use our services, you travel independently and follow the itinerary and programme set out in our offer under your own responsibility and at your own risks. Our company organises the logistics of your tour or stay, purchases on a best effort basis transportation (coach, train, vessel or otherwise), books hotel and other lodging accommodations, restaurant, car rental, handles ground and other services from various independent suppliers, hires guides and local assistants. All such persons and entities are independent contractors. As a result we are not liable for strikes, disruptions, any negligent or willful act of any such contractor, organisation, company, entity or more generally any third person. We do nevertheless commit ourselves to providing follow-up and assistance during your journey to the full extent of our capabilities. Also, if damages were caused by yourself or every person accompanying you at one of our service providers, you would be considered as completely responsible for damages and you would be responsible to repair your damages with our provider.

Article 06 - Tailor made private tours and corporate luxury travel arrangements :

itinerary, programme, cost estimate and confirmation After reception of your demand of customized travel, we confirm you if we are capable of preparing you a proposition. A proposition of customized travel always implies the realization of an important work of preparation. In the answer is yes we proceed in the way which follows.

6.1 Proposition
First case: You will have indicated us in your demand, the exact chosen route with the stages, dates and places which you wish to discover by e-mail.

Second case: You wait that we establish for you, on our initiative and on our recommendations, the route, the places to be discovered, the means of transportation to be used, the hotels where to stay, guides and services of spot reception. In the both case, our proposition is free.

6.2 Order confirmation
We shall send you then an offer which will be precise and reliable but will not bring in inevitably in greatest detail your travel. We shall communicate with you at the same time our estimate for our whole service. You will arrange all the necessary elements to decide to accept our proposition or to refuse it.

If you accept our proposition, it will be asked to you to confirm your agreement by e-mail. You will receive then the invoice corresponding to this proposition which will contain the travel’s price, the dates and the terms of payment.

6.3 Modification during the phase of preparation of your travel
Once the proposition was chosen, you will have the possibility of asking for changes concerning the details of our proposition, you will receive a definitive invoice taking into account relative possible modifications in the conditions of price and of payments ensuing from changes which would have been introduced in your demand and according to your agreement.

6.4 Travel Documents
All the documents necessary to your journey will be sent to you by e-mail in the form of documents PDF so that you can print them easily. The originals of these documents will be also handed to you during our meeting at the airport.

6.5 Follow up during your travel
We shall proceed to a systematic check with all the suppliers two in three weeks before your departure to insure us that everything is in order. A hotline will allow you to contact us 7 days a week during your journey if you consider it necessary.

Article 07 - Tailor made private tours and corporate luxury travel arrangements :

7.1 The price indicated in our initial is based on the data supplied by travel resource suppliers (hotels, restaurants, transfers, car rental companies, guides etc…) at the time of submission. These prices may vary substantially in short periods of time notably as regards airlines tickets. It is of the essence of tailor made private tours that final costs cannot be assessed with absolute certainty until final payments are made to the travel suppliers.

7.2 Once you have accepted our offer we shall establish you a final invoice resuming the price and the terms of payment which were indicated to you in the proposition.

7.3 The costs (or savings) brought about by the changes in the itinerary and/or the programme which you might have requested while our counsellor is working out the details of your tour will be submitted to you for approval. If you approve them. If you do not approve them, we shall revert to our initial offer. We are in every case under no obligation to give the breakdown of costs involved in any of our services.

7.4 Once the final proposition was established, and if this one differs from the initial proposition, a final invoice with definitive price will be established and will be sent to you. She will confirm the terms of payment already mentioned in the initial invoice except in the case either such or such change intervened and approved by you involved modifications of these last ones. If the final proposition and the initial proposition remain identical, no final invoice will be sent to you and the initial invoice will be considered for being the final invoice.

7.5 Once taken collected the totality of the price according to the terms of payment established in the final invoice this one becomes definitive and cannot be any more modified. Mutually it remains modifiable as long as the definitive payment was not made.

Article 08 - Tailor made private tours and corporate luxury travel arrangements:

8.1 The initial invoice as the final invoice will be sent to you in the form of electronic document (generally PDF). They can be faxed to you if you possess a fax. We do not send by post traditional paper documents except formal request of your part.

8.2 The payment schedule indicated in our invoice(s) is an essential part of our contractual agreement with you as price and availability conditions from our suppliers and contractors change very quickly until they have been paid in full. Should you fail to comply with the payments schedule indicated in our invoice, we retain the right to either modify our price, or to cancel our contract with you.

8.3 We normally request payments to be made by bank transfers.

Article 09 - Miscellaneous

9.1 COSTS NEVER INCLUDED IN OUR OFFERS
A passenger travel protection programme, which provides cancellation coverage, medical coverage and protection against lost or damaged luggage, is never included in our offer, even though such is strongly recommended. The cost of obtaining passports or entry visas; excess baggage charges; gratuities ; meals and beverages other than specified in the itinerary; sightseeing not included in the itinerary; personal expenses such as laundry, communication charges and optional activities (which are subject to availability) are never included in our offers.

9.2 SPECIAL REQUESTS
Special Requests such as smoking/non-smoking, adjacent or connecting rooms and special dietary needs should be advised at time of booking. Please note that every effort will be made to secure your special request; however, these requests cannot be guaranteed. Prices and arrangements will be based on current rates of exchange, tariffs and taxes as of the date of confirmation of our final acceptance of your special request.

9.3 HOTEL CHECK IN
Most hotels allows check-in to take place during the mid-afternoon. Should you wish to have your room ready for immediate check-in upon arrival, we could request it but with no guarantee of availability and usually for an additional charge.

9.4 BAGGAGE
Weight restrictions on some routes on internal or international air flights may apply. Baggage and personal effects are at owner's risk throughout the travel programme. Please check before departure with the selected air carrier for baggage restrictions applicable to your flights.

9.5 PASSPORTS AND VISAS
Passports and visas are your own responsibility. Valid passports are required for travel to a number of destinations. Please check. Check as well for the latest visa requirements.

9.6 PHYSICAL RISKS
Some programmes require a minimum level of fitness to participate in and to enjoy when they include certain inherent risks like walking on rough terrain, white water rafting, kayaking and rafting, horseback riding, hiking, walking safaris, downhill or cross country skiing and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. It is your sole responsibility to assume all such risks but we nevertheless advise you to inform us beforehand if you have any physical or other condition or disability that could create a hazard to yourself.

Article 10 - Cancellations

10.1 Cancellation of your personalised tour or travel arrangement for whichever cause between the date of your acceptance of our offer 30 calendar days after the date of acceptance whichever comes last - carries a cancellation fee equal to 20 % of the total price indicated in our initial pro forma Invoice plus all payments made by us to third parties in connection with our pro forma offer evidenced as having not been recouped from such third parties.

10.2 Cancellation of your tailor made tour or travel arrangement for whichever cause carries a cancellation fee equal to 50 % of the total price indicated in our final Invoice plus all payments made by us to third parties in connection with our detailed offer evidenced as having not been recouped from such third parties. All payments received from you until the date of your cancellation will be returned to you after deduction of our cancellation fee and of the payments made by us to third parties in connection with our detailed offer evidenced as having not been recouped from such third parties.

10.3 In spite of the conditions foreseen in § 10.1 and § 10.2, if you cancel your customized journey for whatever talks whether it the complete payment of the price is less than 30 calendar days before date planned for the departure, indicated on our final invoice will remain due.

10.4 We strongly recommend the purchase of insurance coverage against cancellation costs.

10.5 Cancellation of hotel bookings In the case of cancellation of room booking in a hotel, Voyage In Provence will charge you nothing and will pay off to you nothing either. You could be however subjected by the establishment where you reserved for specific clauses of cancellation which vary according to each of them. We recommend you to verify directly with the establishment concerned before cancelling.

10.6 In case, we would insure directly ourselves the payment of your stay the hotel. The cancellation of your booking involves the payment of cancellation expenses charged by the hotel.

10.7 If you do not show up at the day planned in your booking, you remain indebted of the totality of the payment of the price.

10.8 Cancellation of bookings made for the other services (restaurants, car rentals, guides etc.). The expenses of cancellation when there will be separately charged to you.

10.9 Any cancellation if it has already given place to a payment will be paid off to you in the conditions foreseen in the article 10.2

Article 11 - Act of God

We cannot be held responsible for your late arrival or no-show, in the event of a visa or transportation ticket application being denied to you, or of any other cause of acts of God. The conditions prevailing in the case of cancellation as established in Article 10 shall be applicable for late arrival, no show, visa denied or any other cause of acts of God.

Article 12 - Claims and refunds

12.1 For verifiable claims to be considered, they must be received in writing within 30 days of the termination – or cancellation - of the tour or of the stay and be accompanied by supporting documentation.

12.2 Refunds are not made for any missed services, except for verifiable extenuating circumstances and subject to our reclaiming the costs involved from the supplier or contractor. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused sightseeing trips or meals. We will not accept any liability for any claims that are not received within 30 days of the termination of your travel programme.

Article 13 - Limitations

Limitations We are not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labour activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

Article 14 - Governing Law

Governing Law In accordance with Voyage In Provence registered office address, the present contract is subject to and governed by French Law. The sole competent jurisdiction to handle any dispute arising from the present contract is the Tribunal of Aix en Provence. We retain nevertheless the exclusive right to choose a different jurisdiction elsewhere should we decide to take the initiative to file a suit against a third party domiciled abroad. The applicable language version of our sales terms and conditions is the French version according to the French law.
